"In order to have a clear grasp of the issues raised in this appeal, it is necessary to define some of the terms used, which are peculiar to shipping contracts:

"When the Admiralty Jurisdiction Act No. 59 of 1991 was enacted, cognizance was taken in Section 1(1)(b) that prior to the commencement of the Act, the exercise of admiralty jurisdiction was not limited to the Federal High Court.

"Jurisdiction of any State High Court and the Federal High Court is donated by the Constitution of the Federal Republic of Nigeria, 1999 (as amended).

"There is clearly a finding by the trial Court which was affirmed by the lower Court that the transaction between the parties is that of houseboat hire.

"From the clear facts of this matter, the transaction in issue was carriage of goods in a ship.

HELD:

"... Howbeit, it remains an entirely different consideration if the said Section 375 of the Merchant Shipping Act 1990 is applicable in favour of the Respondent.
