"Special damage comprises all past pecuniary losses which are calculated at the date of trial: HALBURY'S LAWS OF ENGLAND 4TH Ed., vol. 36(1) paragraph 28, pages 21.

"It has to be remembered that strict proof of special damage does not mean unusual proof.

"...Even where the claim is understood to mean a claim simply for breach of contract which should put the Cross-Appellant in the position it would have been if the contract had not been breached, the claim cannot succeed.

"It is settled that a claim for general damages or distinction between general and special damages are inappropriate in an action for breach of contract.

"The conduct and action of the Appellant clearly constituted a breach of the contract between them and the Respondent thereby incurring liability to pay damages by the operation of the law, to the Respondent for the breach.
