"In this connection, it ought to be stressed that rights which have been conferred on sellers or buyers under the Sale of Goods Act, 1893 are rights that arise under the contract between the parties by the implication of law.

"Without doubt, Section 43(1) of the Sale of Goods Act,1893 provides that the unpaid seller of goods loses his right of lien or right of retention when, inter alia, the buyer or his agent lawfully obtains possession of the goods.

"It is thus settled that the right of the seller to sue for the price of the goods is independent of his other remedies against the goods.
